The primary administrative authority is the Trademark Office within the Ministry of Industry and Minerals (for Federal Iraq), while the Kurdistan Region maintains its own administrative procedures.
International Standing: Iraq is a member of the World Intellectual Property Organization (WIPO) and a signatory to the Paris Convention for the Protection of Industrial Property. Crucially, Iraq is not a member of the Madrid Protocol as of early 2026. This means that international registrations cannot be extended to Iraq; Markone ensures protection exclusively through direct national filings with the local registry.

A patent is valid for 20 years starting from the date of completing the application submitted to the Patent Office. Such validity is subject to the payment of the prescribed annual fees that are calculated from the date of completing the filing requirements.
Compulsory Licensing
If the owner of a patented invention in Iraq does not satisfy the stipulated working requirements within 3 years, as of the date of grant, or if the working of the invention ceases for 2 consecutive years, the patent will be subject to compulsory licensing under the provisions of the law.
